विवादित निजी भूमि पर मोबाइल टावर लगाने का आरोप, अनुमति रद्द कर टावर हटाने की मांग
खुलताबाद | प्रतिनिधि श्री संजय जाधव खुलताबाद में एक विवादित भूमि पर मोबाइल टावर स्थापित किए जाने को लेकर विवाद गहरा गया है। स्थानीय निवासी श्री सैयद इरशाद सैयद जियाउद्दीन ने मुख्याधिकारी, नगर परिषद खुलताबाद को ज्ञापन सौंपकर संबंधित कंपनी को दी गई अथवा प्रस्तावित अनुमति रद्द करने तथा स्थापित मोबाइल टावर को तत्काल हटाने की मांग की है। इस संबंध में जिलाधिकारी एवं राज्य के नगर विकास विभाग को भी शिकायत की प्रतिलिपि भेजी गई है। ज्ञापन में कहा गया है कि जिस भूमि पर मोबाइल टावर स्थापित किया गया है, वह सार्वजनिक भूमि नहीं है, बल्कि उक्त भूमि पर सैयद जियाउद्दीन सैयद फसियुद्दीन द्वारा स्वामित्व का दावा किया गया है। भूमि स्वामित्व का मामला वर्तमान में न्यायालय में विचाराधीन है। उपलब्ध न्यायालयीन अभिलेखों के अनुसार आर.सी.एस. क्रमांक 886/2023, सैयद जियाउद्दीन सैयद फसियुद्दीन बनाम तहसीलदार प्रकरण संयुक्त सिविल न्यायाधीश (वरिष्ठ विभाग), औरंगाबाद के समक्ष लंबित है। दावेदार का कहना है कि यह भूमि उनके पूर्वजों के समय से उनके परिवार के कब्जे और उपयोग में रही है तथा इस पर उनका वैध अधिकार है। ऐसे में उनकी जानकारी और सहमति के बिना किसी कंपनी द्वारा मोबाइल टावर स्थापित किया जाना अवैध है। शिकायतकर्ता ने आरोप लगाया है कि भूमि विवाद न्यायालय में लंबित होने के बावजूद संबंधित पक्षों की अनुमति लिए बिना टावर खड़ा किया गया। उनका कहना है कि जब तक न्यायालय भूमि स्वामित्व को लेकर अंतिम निर्णय नहीं देता, तब तक इस भूमि पर किसी भी प्रकार का स्थायी निर्माण कार्य नहीं किया जाना चाहिए। ज्ञापन में यह भी उल्लेख किया गया है कि न्यायालयीन कार्यवाही अभी जारी है और मामला साक्ष्य (Evidence) के चरण में है। इसलिए विवादित भूमि पर मोबाइल टावर की स्थापना को लेकर गंभीर कानूनी प्रश्न उत्पन्न हो गए हैं। शिकायतकर्ता ने मांग की है कि मोबाइल टावर को तत्काल हटाया जाए, भूमि से संबंधित सभी निर्माण और प्रशासनिक प्रक्रियाओं पर रोक लगाई जाए तथा पूरे प्रकरण की निष्पक्ष जांच कर जिम्मेदार अधिकारियों और संबंधित पक्षों के विरुद्ध आवश्यक कार्रवाई की जाए। शेख जफर शेख बशीर ने चेतावनी दी है कि यदि उनकी मांगों पर उचित कार्रवाई नहीं हुई तो वे न्याय प्राप्त करने के लिए उच्च न्यायालय का दरवाजा खटखटाएंगे। Allegations Over Mobile Tower Installation on Disputed Private Land Demand Raised for Removal and Cancellation of Permission Khultabad | Correspondent A controversy has emerged in Khultabad over the installation of a mobile tower on a disputed piece of land. Local resident Mr. Syed Irshad Syed Ziauddinhas submitted a memorandum to the Chief Officer of the Khultabad Municipal Council, demanding the immediate cancellation of any permission granted or proposed to be granted to the concerned company and the removal of the mobile tower from the site. Copies of the complaint have also been forwarded to the District Collector and the State Urban Development Department. According to the memorandum, the land in question is not public property. Instead, ownership of the land has been claimed by Syed Ziyauddin Syed Fasihuddin, and the matter is currently pending before a competent court. Court records indicate that Regular Civil Suit (R.C.S.) No. 886/2023, Syed Ziyauddin Syed Fasihuddin versus Tahsildar, is under consideration before the Court of the Joint Civil Judge Senior Division, Aurangabad. The claimant has stated that the land has been in the possession and use of his family since the time of his forefathers and that they hold lawful rights over it. Therefore, he alleges that the installation of a mobile tower without his knowledge or consent is illegal and amounts to an infringement of his property rights. The memorandum further alleges that the mobile tower was erected without obtaining permission from the claimant and despite the fact that the ownership dispute is still sub judice. It argues that no permanent construction should have been undertaken on the land until the court reaches a final decision regarding ownership. It has also been pointed out that the civil suit remains pending and is currently at the stage of recording evidence. As a result, the installation of the mobile tower on the disputed land has raised serious legal concerns. The complainant has demanded the immediate removal of the mobile tower, a halt to all construction and administrative processes related to the site, and a fair and impartial inquiry into the matter. He has also called for action against any officials or parties found responsible for violating legal procedures. Sheikh Jafar Sheikh Bashir stated that if the authorities fail to take appropriate action on his demands, he will seek justice through the High Court. He reiterated that until the ownership dispute is resolved by the court, no private company should be allowed to utilize or develop the disputed land. (Note: The ownership of the land is currently under judicial consideration, and the final determination will be subject to the court's decision.)
