The Appellant has submitted a second appeal under Section 19(3) of the Right to Information Act, 2005 to the State Information Commission Sub Office Chhatrapati Sambhajinagar on 22.11.2023. Appellant Iqbal Gani Patel and respondent have been informed by the Commission through notice for the hearing of the second appeal. The agenda of the hearing has been published on the website of the Commission. In the context of the hearing, all the concerned parties have been instructed to submit their statements and documents.

During this hearing, the appellant Patel was present, but the Public Information Officer and the then Officers of Khulabad Municipal Council Sambhaji Wagh were the first appellate officer.

This was the episode - 

The appellant sent the report of 65/85 of the Sheikh Committee under Waqf Board, which was sent to the city council office by the appellant Iqbal Gani Patel by applying to the Mahiti right.

# Information presented in hearing:

The Appellant informed during the hearing that the information sought through the information application has not been received yet. The Appellant also said that this information is necessary for him and an order should be given to make it available immediately.

The Commission found that the Public Information Officer did not respond within the stipulated time limit of the appellant. Therefore, the Commission has passed the following order .The current Public Information Officer and the office superintendent of the city council, Khulatabad, District Chhatrapati Sambhajinagar did not respond within the time limit of the information. This is a violation of Section 7 (1) of the Right to Information Act, 2005 .The Public Information Officer will have to submit an explanation to the Commission as to why action should not be taken under Section 19(8)(p) and 20(1) of the Act within 30 days from the date of receipt of the orderIf the Public Information Officers fail to submit any clarification during this period, the Commission will pass the final order against them under the above provisions. The order of use will be

final and binding .
