राज्य माहिती आयुक्त प्रकाश इंदेलकर का आदेश: 06.10.2023 के RTI अर्ज का जवाब नहीं दिया था | जावक क्र. 3224 से जारी हुआ आदेश खुल्ताबाद | प्रतिनिधि श्री संजय जाधव | 24 जून 2026 सूचना का अधिकार कानून में लापरवाही बरतने वाले अधिकारियों पर राज्य माहिती आयोग ने शिकंजा कस दिया है। खुल्ताबाद नगर परिषद के तत्कालीन जन माहिती अधिकारी पर आयोग ने 5000 रुपये की शास्ति अंतिम रूप से तय कर दी है। जुर्माना वसूलने की जिम्मेदारी अब ज़िलाधिकारी, छत्रपती संभाजीनगर पर होगी। आदेश में क्या है? राज्य माहिती आयुक्त प्रकाश इंदेलकर, खंडपीठ छत्रपती संभाजीनगर ने 06.12.2024 के अपने आदेश में लिखा है: "संबंधित जन माहिती अधिकारी तथा नगर परिषद कार्यालय खुल्ताबाद, जि. छत्रपती संभाजीनगर यांना या प्रकरणी रु. 5000/- (अक्षरी पाँच हजार रुपये) इतकी शास्ति अंतिम करण्यात येत आहे।" क्यों लगा जुर्माना? 1. तारीख: अपीलकर्ता मोहम्मद सलीमोद्दीन हफीजोद्दीन का माहिती का अर्ज दि. 06.10.2023 का था। 2. उल्लंघन: अधिनियम की धारा 7(1) के तहत 30 दिन में जानकारी नहीं दी गई। 3. अवहेलना आयोग के 08.12.2023 के कारण बताओ नोटिस का भी अधिकारी ने कोई जवाब नहीं दिया। 4. निष्कर्ष आयोग ने इसे "जानबूझकर की गई लापरवाही" माना और धारा 20(1) के तहत शास्ति लगाई। पैसा कहां जमा होगा? आदेश में स्पष्ट है कि वसूली गई रकम "0070 - इतर प्रशासनिक सेवा, 60 - इतर सेवा, 800 - इतर जमा रक्कम, 98 - माहितीचा अधिकार 0070-096-1" इस लेखाशीर्ष में जमा की जाएगी। यह कार्रवाई धारा 19(8)(क) और 19(8) के तहत की जा रही है। आदेश की कॉपी किसे गई? यह आदेश जावक क्र. 3224 दि. 06.12.2026 से जारी हुआ है। इसकी प्रतिलिपि माहिती तथा आवश्यक कार्यवाही के लिए दो जगह भेजी गई है: 1. ज़िलाधिकारी, ज़िलाधिकारी कार्यालय, छत्रपती संभाजीनगर 2. ज़िलाधिकारी के मार्फत संबंधित जन माहिती अधिकारी तथा नगर परिषद कार्यालय खुल्ताबाद ज़िलाधिकारी कार्यालय को अब संबंधित अधिकारी से 5000 रुपये की वसूली करनी है और रिपोर्ट आयोग को भेजनी है। आयोग ने यह भी स्पष्ट किया है कि द्वितीय अपील में दिए गए जानकारी उपलब्ध कराने के निर्देश कायम रहेंगे। प्रशासन में हड़कंप आयोग के इस अंतिम आदेश के बाद खुल्ताबाद नगर परिषद में खलबली मच गई है। RTI कार्यकर्ताओं ने फैसले का स्वागत करते हुए कहा कि इससे सरकारी महकमों में जवाबदेही और पारदर्शिता बढ़ेगी। खुल्ताबाद नगर परिषद पर 5000 रु. का जुर्माना। RTI का जवाब न देने पर राज्य माहिती आयोग का सख्त आदेश। 06.10.2023 के अर्ज पर जानकारी नहीं दी थी। ज़िलाधिकारी वसूलेंगे रकम। जावक क्र. 3224 से आदेश जारी। जन माहिती अधिकारी पर कार्रवाई तय। RTI Negligence Costs Khuldabad Nagar Parishad: State Information Commission Imposes Final Penalty of Rs 5000 on Public Information Officer Collector directed to recover fine for not providing info on 06.10.2023 RTI application | Order issued via Outward No. 3224 Khuldabad | Correspondent | 24 June 2026 The State Information Commission has cracked down on officials taking the Right to Information Act lightly. The Commission, Bench at Chhatrapati Sambhajinagar, has finally imposed a penalty of Rs 5000/- on the then Public Information Officer of Khuldabad Nagar Parishad for negligence in an RTI matter. What does the order state? In his order dated 06.12.2024, State Information Commissioner Prakash Indelkar stated: "A final penalty of Rs. 5000/- (Rupees Five Thousand only) is hereby imposed on the concerned Public Information Officer and Nagar Parishad Office, Khuldabad, Dist. Chhatrapati Sambhajinagar in this case." Why was the penalty imposed? 1. Date: The information request by appellant Mohammad Salimoddin Hafizoddin was dated 06.10.2023. 2. Violation: Information was not provided within the 30-day limit under Section 7(1) of the Act. 3. Non-compliance: The officer also failed to reply to the Commission's show-cause notice dated 08.12.2023. 4. Conclusion: The Commission held this to be "deliberate negligence" and imposed the penalty under Section 20(1) of the RTI Act, 2005. Where will the money be deposited? The order directs that the recovered penalty amount be deposited under the head "0070 - Other Administrative Services, 60 - Other Services, 800 - Other Receipts, 98 - Right to Information 0070-096-1". This action is being taken under Sections 19(8)(a) and 19(8). Who received the order copy? The order was issued vide Outward No. 3224 dated 06.12.2026. Copies have been sent for information and necessary action to: 1. The Collector, Collector Office, Chhatrapati Sambhajinagar 2. Through the Collector, to the concerned Public Information Officer and Nagar Parishad Office, Khuldabad. What happens next? The Collector’s office now has to recover the Rs 5000 from the concerned officer and send a compliance report to the Commission. The Commission also clarified that its earlier direction to provide information to the appellant in the second appeal remains in force. Stir in administration The Commission’s final order has created a stir in Khuldabad Nagar Parishad. RTI activists have welcomed the decision, saying it will increase accountability and transparency in government offices.
